NOTICE OF PRIVACY PRACTICES

WIP Ecom LLC (“Carhartt Work in Progress,” Carhartt WIP,” “we,” “our,” or “us”) recognizes that you care about how information about you is used and shared and respects your privacy. This notice of privacy practices (“Notice”) informs you of how information is collected on and through the Carhartt WIP website, located at www.us.carhartt-wip.com (the “Website”), how we may use the information and with whom we may share it. This Notice also describes the measures we take to safeguard the information we collect and your rights concerning our collection, use and disclosure of information about you. Information collected on or through this Website may be collected by Carhartt WIP or by third-party service providers acting on our behalf.

For clarification, this Notice applies only to information collected through the Website and does not necessarily describe the ways in which we may collect or use information obtained from other sites we operate or other means (such as offline), or the collection, use and disclosure practices of any of Carhartt WIP’s corporate affiliates (“Affiliates”) or business partners who make our products available on their websites or other third parties. We may update this Notice from time to time to provide clarification or notice of changes to our practices. All such changes will be effective upon posting the revised Notice on the Website and we will revise the “Last Updated” legend at the top of this Notice. Your continued use of the Website constitutes your acceptance to such changes. GENERAL AUDIENCE WEBSITE

Services offered by Carhartt WIP are not directed to individuals under the age of thirteen (13). Carhartt WIP does not knowingly collect Personal Information (as defined below) from individuals under thirteen (13) years of age. No information should be submitted to or posted to the Website by visitors younger than thirteen (13) years old. Furthermore, we may restrict entries to any contests, sweepstakes or promotions to entrants who are at least 18 years of age or the age of majority.

INFORMATION WE COLLECT

Carhartt WIP collects information in two ways: (1) directly from you, and (2) automatically as a result of your use of the Website and/or services. Much of the Website is accessible without providing any Personal Information. However, in order to set up an account, place an order or to take advantage of certain features of the Website, such as online surveys, promotions, contests and sweepstakes, product registration or to sign up for newsletters, we may require that you provide Personal Information. If you do not provide your Personal Information, you will not be able to use these areas or features of the Website. The Personal Information (as defined below) that you provide to us and the information we collect automatically is collectively referred to as “Collected Information” throughout this Notice.

Personal Information

As used in this Notice, “Personal Information” means information about an identifiable individual. Examples of Personal Information that we may collect include name, billing address, shipping address, telephone number, email address, birthdate, payment information (including payment card number or online payment service number) and related information.

If you provide Carhartt WIP with Personal Information about a person other than yourself, you represent and warrant that you are authorized by that person to provide their Personal Information to us for the purposes for which you provided it.

Information Collected Automatically

When you visit the Website, certain information regarding your use of the Website or our services is collected and/or aggregated by or on behalf of Carhartt WIP through the use of automated means. The information collected automatically may include information about your visit to, and use of, the Website, such as your IP address, type of browser and operating system used, date and time you access the Website, pages you visit, search engine used to access the Website, and if you linked to the Website from another website, the address of that website.

Using the information collected about you over time, we may engage in interest-based advertising, or “online behavioral advertising”, which includes ads presented to you after you leave our Website that encourage you to return. These ads may also include offers we think are relevant to you based on your shopping habits or online activities, and they may be served on websites or applications. We may serve these ads, or third party advertisers and ad networks such as Google AdWords and Facebook or other social media providers may serve you these ads. We use the Collected Information for a variety of purposes, including without limitation:  

  1. for our business purposes, such as establishing and managing your customer account, providing products and services you request (such as processing and shipping orders and sending order and shipping confirmations), processing and collecting payments and providing customer support, communicating with you and responding to your inquiries and requests, and to send you important administrative communications regarding the Website;
  2. to offer our products or services and/or the products or services of others to you, to contact you about selected products, services, and events and other information we think may interest you, or to communicate with you about special events, programs, surveys, contests, sweepstakes, and other offers or promotions;
  3. to create a more personalized user experience and to target and deliver content (including interest based advertising and promotional messaging) correlating to our users’ interests based on the ways in which our users interact with the Website, third party websites and advertisements;
  4. to administer your participation in special events, programs, surveys, contests, sweepstakes, and other offers or promotions;

  1. Service Providers. We may engage third parties, including Affiliates, to provide certain services on our behalf including website development, order fulfillment, payment processing and collection, website hosting, data storage, administration of surveys, sweepstakes, contests or other promotions, and e-mail administration. Examples of our current services include Shopify, Return Magic, Findify, Kustomer, MailChimp, Campaign Monitor and Back in Stock, but our service providers may change as we determine necessary to fulfill the needs of our business. Our service providers may be located outside of the United States and Canada and as a result, your Personal Information may be processed and stored outside of the United States and Canada. The reasonable contractual or other measures we may take to protect your Personal Information while processed or handled by these service providers may be subject to applicable foreign legal requirements.
  2. Advertising Networks. We may work with advertising networks that deliver targeted advertisements to consumers and generate statistics and metrics related to the delivery of such advertisements. Advertising networks collect information about the websites that you visit and the advertisements that you interact with using tools such as cookies, web server logs and web beacons. This information is used to serve you targeted ads based on your inferred interests and preferences as well as for auditing, research and reporting to us, our Affiliates and other advertisers. This data collection takes place both on this Website and on third-party websites that participate in the advertising networks. When you visit websites or view or interact with an advertisement, the possibility exists that the advertiser will make the assumption that you are interested in the subject matter of the advertisements.
  3. Other Third Parties. We may disclose information, including Personal Information, to: (i) protect or defend our interests and the legal rights or property of Carhartt WIP and our Affiliates; (ii) protect the rights, interest and safety and security of users of our Website or members of the public; (iii) protect against fraud or for risk management purposes; or (iv) comply with applicable law or legal process. In addition, if we sell all or substantially all of our business, or sell or transfer all or a material part of our assets, or are otherwise involved in a merger or transfer of all or a material part of our business or associated negotiations (including transfers made as part of insolvency or bankruptcy proceedings), we may transfer all information we have collected and stored, including your Personal Information, to the party or parties involved in the transaction as part of that transaction.

We may sell or share non-personally identifiable data, including anonymized data derived from Personal Information collected from the Website, with third parties, including our Affiliates, dealers, marketing businesses and lead generation businesses, for any purpose.

YOUR CHOICES

Accessing and Modifying Your Personal Information. You may correct, update and delete the information contained in your online account through the “My Account” page on the Website or by contacting us in writing as specified in the “How to Contact Us” section below. Please note that we may retain some Collected Information for archival and record retention purposes.

Communication Preferences. You may choose not to receive marketing email communications from us by clicking on the unsubscribe link in our marketing emails. You may still receive service oriented, administrative communications from us, as you cannot opt-out of receiving such administrative communications.

Cookies. You may be able to opt-out of the automatic collection via cookies of some information by referring to your web browser’s or mobile device’s options or settings menu and adjusting the settings to accept to reject cookies. You may also render some web beacons unusable by rejecting their associated cookies. Each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences or visit http://www.allaboutcookies.org/  for more information. You can also refer to the “Help” menu of your browser to learn more about Web Beacons and your ability to disable them. Disabling or rejecting cookies may disable many of the features and functionality of the Website and/or services.

Google Analytics Solutions. Google provides users choices on how their data is collected by Google’s Analytics Solutions through an Opt-out Browser Add-on which can be located at: http://tools.google.com/dlpage/gaoptout?hl=en. By installing this Add-on, no information is being sent to Google Analytics.

Social Media. Some social media providers allow you to control the interest based advertisements that you see through their platforms. Please review the privacy policy of the applicable social media provider and the settings section of your social media account.

NAI. Many companies that collect information for targeted advertising are members of the Network Advertising Initiative (“NAI”). NAI offers the ability for you to opt-out of the targeted advertising programs of their members by going to http://www.networkadvertising.org/managing/opt_out.asp, http://www.aboutads.info/choices or http://youradchoices.ca. Please note that if you use a different computer, change your web browser, or delete your cookies, you will need to renew all of your opt-out choices. Please also note that this does not opt you out of being served advertising, but only excludes you from targeted (i.e. interest-based) advertising. If you use the Carhartt WIP website or Affiliate websites, you will continue to receive generic advertisements.

Please be aware that if you do not allow us to collect and use your information, portions of the Website’s features and functionality will not operate correctly and we may not be able to provide you with certain services.

Once you leave the Website, we suggest that you review the applicable privacy policy of the third party website regarding, among other things, how they will handle any personal information they collect from you. We are not responsible for the content of third party websites, your use of those websites, or the privacy practices of those websites.

SECURITY AND DATA RETENTION

Carhartt WIP takes commercially reasonable measures to secure and protect information transmitted via or stored on the Website. Despite these measures, we cannot guarantee the security of networks, servers and databases we operate or that are operated on our behalf or that the information you transmit to Carhartt WIP over the Internet will not be intercepted, deleted or altered.

We reserve the right to retain any Collected Information reasonably necessary to document our business activities and for archival and record retention purposes.

CALIFORNIA PRIVACY RIGHTS

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship the following information: (a) a list of the categories of personally identifiable information, such as name, e-mail, and mailing address, and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes, and (b) the name and address of all such third parties. For all requests, you must put the statement “Your California Privacy Rights” in the body of your request, as well as your name, street address, city, state, and zip code. Please note that we are not responsible for notices that are not labeled or sent properly, or that do not have complete information. Please allow 30 days for a response.

CALIFORNIA AND DELAWARE "DO NOT TRACK" DISCLOSURES

California and Delaware law require Carhartt WIP to indicate whether it honors “Do Not Track” settings in your browser concerning targeted advertising. At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, like many other websites and online services, we are currently unable to respond to Do Not Track Signals. CANADA PRIVACY RIGHTS
